1. Who we are

Dearly ("the Game") and the website playdearly.com ("the Website") are operated by the individual named in the Impressum ("we", "us"). By downloading, installing or playing the Game, or using the Website, you agree to these Terms.

2. The Game

Dearly is a casual idle game. We grant you a personal, non-exclusive, non-transferable, revocable licence to play the Game on devices you own or control, for private, non-commercial use.

3. Accounts and saves

You may continue without an account, in which case progress stays on that device. If you choose an account, you must provide accurate sign-in information and keep its credentials secure. Cloud backup is provided to help restore or carry a save, but it is not a substitute for keeping access to your device and account.

4. Virtual items and currency

Coins, Soulglow and other earned in-game items are virtual. They have no monetary value and cannot be exchanged for real money or goods. Soulglow is earned through play and is not sold. Dearly offers two optional, non-consumable purchases: the Candlelight Supporter Pack and the Turning Seasons Theme. Each permanently unlocks the cosmetic content described on its App Store product page and does not accelerate progress, increase income or bypass waiting.

Purchases are billed by Apple at the price shown in the App Store purchase sheet and are associated with your Apple ID. You can recover supported ownership using Restore Purchases in Settings. Refund requests and billing disputes are handled by Apple under App Store rules and applicable law. If Apple refunds or revokes a transaction, the related paid cosmetic entitlement may be removed. Your mandatory consumer rights, including any applicable withdrawal or refund rights, remain unaffected.

5. Fair use

You agree not to: reverse engineer, decompile or modify the Game except where the law permits; exploit bugs, use automation or interfere with our servers; or use the Game or Website for anything unlawful.

6. Availability

The base Game is available without charge and optional purchases are not required to complete the free journey. We may update, change, suspend or discontinue the Game or an online feature (including cloud saves), subject to applicable law and without removing rights that mandatory law gives you for purchased content. We do our best, but we do not promise uninterrupted or error-free operation.

7. Intellectual property

All artwork, names, code, music and other content in the Game and on the Website are our property or used with permission and are protected by copyright. You may share screenshots and videos of the Game for personal, non-commercial purposes.

8. Liability

We are liable without limitation for intent and gross negligence and under mandatory statutory provisions (e.g. product liability law, injury to life, body or health). For slight negligence, we are liable only for breaches of essential contractual duties, limited to the foreseeable damage typical for this kind of service. Any further liability is excluded to the extent permitted by law.

9. Changes to these Terms

We may update these Terms from time to time. The current version is always available at playdearly.com/terms. Material changes will be indicated by updating the date above.

10. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer-protection rules of your country of residence remain unaffected.
